Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Crewlio platform at getcrewlio.com and related applications (the “Platform”), operated by Crewlio Pty Ltd (ABN 31 699 068 472) (“Crewlio”, “we”, “us”, “our”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • Talent — a user who offers to work shifts through the Platform.
  • Employer or Organisation — a user who posts shifts or seeks to engage Talent.
  • Subscription — a paid plan giving access to Platform features.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You must provide accurate information, keep it up to date, and keep your login credentials secure. You are responsible for all activity under your account. You are responsible for ensuring you hold any qualifications, registrations, licences and rights to work that apply to you.

3. What Crewlio is — and is not

Crewlio is a technology platform that helps Employers and Talent find and connect with each other. Crewlio is not an employer, employment agency, labour-hire provider, or a party to any arrangement between an Employer and Talent. Key points you agree to and understand:

  • Any booking, shift, engagement or contract is directly between the Employer and the Talent. Crewlio is not a party to it.
  • Crewlio does not process payments between Employers and Talent and does not pay wages. Employers pay Talent directly, outside the Platform. Crewlio's only charges are subscription fees for access to the Platform.
  • Crewlio does not guarantee that any shift will be filled, that any Talent will be booked, or the quality, conduct, suitability, qualifications or credentials of any user.
  • Employers and Talent are solely responsible for their own compliance with all applicable laws, including workplace, award, superannuation, tax, insurance, work health and safety, licensing and right-to-work obligations.
  • No employment, agency, partnership or joint-venture relationship is created between you and Crewlio by using the Platform.

4. Subscriptions, fees and billing

  • Access to paid features requires a Subscription. Fees, inclusions and billing cycle are shown at the point of purchase.
  • Subscriptions are billed in advance on a recurring basis through our payment provider (Stripe) and renew automatically until cancelled.
  • Crewlio charges no commission and no per-shift fees.
  • Fees are stated in Australian dollars and, where applicable, are inclusive of or subject to GST.
  • You can cancel at any time; cancellation takes effect at the end of your current billing period. Except where required by law (including the Australian Consumer Law), fees already paid are non-refundable.
  • We may change pricing or plan features with reasonable notice; changes apply from your next billing period.

5. Acceptable use

You agree not to misuse the Platform. You must not: provide false or misleading information; impersonate others; post unlawful, discriminatory, harassing or fraudulent content; misrepresent qualifications or credentials; scrape, copy, reverse engineer or attempt to gain unauthorised access to the Platform; interfere with its operation or security; or use it to circumvent subscription fees or for any unlawful purpose.

6. Your content

You retain ownership of the content you submit (including profile details, documents and messages). You grant Crewlio a non-exclusive, worldwide licence to host, store, display and use that content as needed to operate and provide the Platform. You are responsible for the accuracy and legality of your content and for ensuring you have the right to share it, including any credentials you present.

7. Verification and credentials

Where the Platform offers verification features, they are provided as a convenience and do not constitute a guarantee. Employers remain responsible for independently verifying the identity, qualifications, registration, credentials and suitability of any Talent before engaging them.

8. Third-party services

The Platform relies on third-party services (such as hosting, email, payments and mapping). Your use of those services may be subject to their own terms, and we are not responsible for them.

9. Intellectual property

The Platform, including its software, design, branding and content (other than user content), is owned by Crewlio and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms. You may not copy, modify or create derivative works from the Platform.

10. Disclaimers

To the maximum extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to re-supplying the relevant service or paying the cost of doing so.

11. Limitation of liability

To the maximum extent permitted by law, Crewlio is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or opportunity, arising from your use of the Platform or any dealings between Employers and Talent. To the extent our liability cannot be excluded, our total liability is limited to the subscription fees you paid to us in the 12 months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify Crewlio against claims, losses and costs arising from your breach of these Terms, your content, or your dealings with other users.

13. Suspension and termination

We may suspend or terminate your access if you breach these Terms or use the Platform in a way that risks harm to others or to Crewlio. You may stop using the Platform and close your account at any time. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date. Your continued use of the Platform after changes take effect means you accept the updated Terms.
